How Illinois Workers' Comp Settlements Work

Under Illinois law, your temporary total disability (TTD) benefits are calculated at 66.7% of your Average Weekly Wage (AWW). This amount is subject to a strict weekly cap of $1,897 per week. The maximum duration you can receive TTD benefits is 104 weeks.
Permanent Partial Disability (PPD) benefits compensate you if you suffer a permanent loss of function after reaching maximum medical recovery. In Illinois, PPD is calculated using the percentage-of-person method (where benefits are calculated out of a whole person week count).
State-Specific Note: Illinois uses a percentage-of-person PPD method rather than the AMA scheduled weeks table. PPD is calculated as: weekly benefit × 500 whole-body weeks × impairment percentage. The weekly cap is among the highest nationally.
